1. Scope of application

These terms and conditions contain the terms and conditions that apply exclusively between you ("customer") and us, Küblker Sport GmbH Fabrikhof 3 8134 Adliswil, when concluding contracts via our online store giordana

2. offer; delivery; reservation of delivery; partial delivery

The presentation of our goods on our website giordana.ch does not constitute a binding offer on our part.

We do not accept offers from customers based outside Switzerland.

If a product ordered by you is permanently unavailable, we reserve the right not to accept your offer or to withdraw from the contract.

3. Our liability

Unless otherwise agreed below, our goods are subject to statutory liability for defects:

We shall be liable - irrespective of the legal grounds - for damages or compensation for futile expenses in accordance with the following provisions under lit. (a) and (b) below:

(a) In the event of intent and gross negligence, we shall be liable without limitation. In the event of simple negligence, we shall only be liable for damages arising from the breach of a material contractual obligation (obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance you may regularly rely and trust); in this case, however, our liability shall be limited to compensation for foreseeable damages typical for the contract.

(b) The exclusions of liability resulting from lit. (a) shall not apply if we have fraudulently concealed a defect or have assumed a guarantee for the quality of the item, for damages resulting from injury to life, body or health, as well as in the case of liability under the Product Liability Act.

Insofar as our liability is excluded or limited, this also applies to the personal liability of our legal representatives and vicarious agents.

4. Conditions for promotional vouchers

The following conditions only apply to promotional vouchers, unless otherwise stated on the voucher. They do not apply to merchandise vouchers (i.e. vouchers purchased against payment (e.g. as a gift)):

Promotional vouchers can only be used in our online store. To redeem a voucher, the same e-mail address must be used for the purchase to which the voucher was sent. Vouchers may not be transferred. Only one voucher can be redeemed per order. Vouchers cannot be combined or redeemed for cash and do not earn interest.

Validity period and minimum order value (incl. VAT, excluding shipping costs and fees) will be announced with the voucher promotion.

The value of the voucher will be distributed proportionally among the goods ordered. If individual items are returned, the voucher will be credited proportionally to the price of the returned goods. If a voucher is linked to a minimum order value, this must also be reached if goods are partially returned, otherwise the voucher value will not be credited. If goods are returned, the amount credited to the promotional voucher will not be refunded and the voucher cannot be used again.

5. Warranty and repairs

Customers are obliged to inspect the delivered products as soon as it is feasible in the normal course of business and to report any defects detected immediately to our branch or our customer service department. If they fail to do so, the products shall be deemed to have been approved. Approval shall in any case be deemed to have been given if customers do not lodge a complaint within 8 days of purchase or delivery. Defects that were not recognizable during proper inspection in accordance with the above paragraph must be reported to our customer service immediately after discovery, otherwise the products shall also be deemed approved with regard to these defects.

The full or partial invalidity or ineffectiveness of individual provisions of these GTC shall not affect the validity of the remaining provisions or parts of such provisions. Invalid or ineffective provisions shall be replaced by provisions that correspond as closely as possible to their legal or economic meaning. The same procedure shall apply if there is a loophole in these GTC.

Cycling clothing is a personal hygiene item. For this reason
we are happy to accept the return of items that are unused, originally labeled and
original packaging. You write us an e-mail and we will send you a label by e-mail. On receipt, you print out the label and stick it on your parcel - ready for dispatch.

The items will be taken back within 10 days, late returns will not be accepted.
In the event of non-compliant returns (used, damaged or not in original packaging, etc.), the full amount will not be refunded.
