1. Scope of Application
These General Terms and Conditions apply to orders placed through the Giordana online shop at shop.giordana.ch, operated by:

Switzerland
They apply to all contracts concluded through this online shop between Kübler Sport GmbH and its customers.
Additional or different conditions may apply to team, club, event and custom collections. Any such conditions will be stated on the relevant product or collection pages.
2. Products, Orders and Delivery
The presentation of products in the Giordana online shop at shop.giordana.ch does not in itself constitute a binding offer to enter into a contract, but an invitation to place an order.
By submitting an order, the customer makes a binding offer to purchase the products contained in the shopping cart. Receipt of the order will be confirmed electronically.
If an ordered item is no longer available despite previously being shown as in stock, we will inform the customer as soon as possible. Any payments already made for unavailable items will be refunded.
Partial deliveries are permitted where reasonable for the customer. No additional shipping costs will be charged where a partial delivery is initiated by us.
Deliveries are made to the countries and regions available during the checkout process.
3. Liability
Kübler Sport GmbH is liable in accordance with the applicable statutory provisions for damage caused intentionally or through gross negligence.
To the extent permitted by law, liability for indirect damage and consequential loss caused by slight negligence is excluded.
Mandatory statutory liability, in particular under the Swiss Product Liability Act (PrHG), remains unaffected.
To the extent permitted by law, Kübler Sport GmbH accepts no liability for damage resulting from improper use, failure to follow care or usage instructions, or normal wear and tear.
4. Terms for Promotional Vouchers
Promotional vouchers may be redeemed in the Giordana online shop in accordance with the conditions of the respective promotion. The validity period, minimum order value, excluded products or collections and any other restrictions will be stated as part of the relevant promotion.
Unless expressly stated otherwise, only one promotional voucher may be used per order. Promotional vouchers cannot be combined, exchanged for cash or earn interest.
In the event of a return, only the amount actually paid for the returned items will be refunded. Any voucher or discount amount allocated to the returned item will not be paid out in cash or reissued.
Gift cards and vouchers purchased for payment are not considered promotional vouchers and are subject to their own separate terms.
5. Defects, Statutory Warranty and Repairs
Customers are required to inspect the products received for obvious defects and transport damage after delivery. Any defects identified should be reported to Kübler Sport GmbH as soon as possible by e-mail to shop@giordana.ch.
Defects that could not reasonably be identified during an ordinary inspection should also be reported as soon as possible after they are discovered.
In the event of a complaint, we ask customers to provide a brief description of the defect and, where possible, clear photographs and proof of purchase. This enables us to assess the case quickly.
The statutory provisions of the Swiss Code of Obligations apply to defects in purchased goods. The statutory limitation period for warranty claims relating to consumer goods is generally two years from delivery of the goods.
Where a valid defect exists, we will assess an appropriate remedy depending on the nature of the defect and the applicable legal requirements, for example repair, replacement, price reduction or cancellation of the purchase.
Warranty coverage does not apply, to the extent permitted by law, to damage caused in particular by normal wear and tear, improper use, crash or accident damage, incorrect care, or failure to follow care and usage instructions.
Any voluntary manufacturer warranties apply independently of the customer's statutory warranty rights and are subject to the respective manufacturer's terms and conditions.
6. Severability
If any provision of these General Terms and Conditions is wholly or partially invalid or unenforceable, the remaining provisions shall remain unaffected.
The applicable statutory provisions shall apply in place of any invalid or unenforceable provision.
7. Returns and Exchanges
For products from the regular Giordana retail collection, Kübler Sport GmbH offers a voluntary return period of 10 calendar days from receipt of the order.
The conditions and procedure for returns are governed by the Returns & Exchanges Policy published in the Giordana online shop.
Reduced items and SALE products are excluded from voluntary returns and exchanges. Valid claims relating to defects or incorrect deliveries remain unaffected.
Different return and exchange conditions may apply to team, club, event and custom collections. These conditions will be stated on the relevant product or collection pages.
8. Applicable Law
The contractual relationship with Kübler Sport GmbH is generally governed by Swiss law.
Mandatory consumer protection provisions applicable due to the customer's place of residence remain unaffected. The statutory places of jurisdiction apply.
